Terms of Service

Last updated:

These Terms of Service ("Terms") govern your use of the claricase.com website and your engagement of document, business registration, DTI, and lawyer referral assistance services from ClariCase ("ClariCase," "we," "us," or "our"). By visiting our website, submitting a consultation request, or engaging our services, you agree to these Terms. If you do not agree, please do not use our website or services.

1. Who we are

ClariCase is a document, business registration, and lawyer referral assistance service based in Davao City, Philippines, primarily serving individuals and small businesses in Davao City and the surrounding Davao Region. Documents are prepared by our team of document specialists, working from official forms, published rules, and other publicly available resources. ClariCase is not a law firm, does not employ attorneys acting in that capacity, and does not provide legal advice or legal representation. See our full Disclaimer for details.

2. Accuracy of information

You agree to provide accurate and complete information about your situation. Documents we prepare are based on the information you provide; we are not responsible for inaccuracies that result from incomplete or incorrect information supplied to us. You are responsible for reviewing every document we prepare before it is filed or sent.

3. Fees and payment

Our services are provided on a flat, one-time fee basis, quoted after a free consultation and confirmed with you in writing before any work begins. All fees are quoted and charged in Philippine pesos (₱) unless otherwise agreed.

Payments are processed securely by a third-party payment processor (such as Xendit, HitPay, or another PCI‑DSS compliant gateway we use from time to time). ClariCase does not store your full card number or bank credentials on our own systems; your payment details are handled directly by our payment processor under its own security and privacy practices. By submitting payment, you confirm that you are authorized to use the payment method provided, and you authorize ClariCase and our payment processor to charge the agreed fee.

Any fees charged by a lawyer we refer you to are separate from, and not included in, fees you pay ClariCase, and are agreed directly between you and that lawyer.

4. Refunds and cancellations

Refunds and cancellations are handled according to our dedicated Refund & Cancellation Policy, which forms part of these Terms. In summary: consultations are free and may be rescheduled or cancelled at no charge; once a paid engagement begins, fees become non-refundable once document or registration preparation work has started, except as described in the Refund & Cancellation Policy or as otherwise required by law. Please review that policy before booking a paid service.

5. Your responsibilities

You are responsible for filing documents with the appropriate court or government office by the applicable deadlines, for reviewing prepared documents for accuracy before filing or sending them, and for complying with all applicable court rules, DTI requirements, and local government regulations. You are solely responsible for the outcome of decisions you make in connection with your case or registration, whether or not based on documents we help prepare, and for any decision to engage a lawyer we refer you to.

6. Nature and limits of our services

We prepare documents and registration paperwork based on the information you give us and publicly available legal and government resources. We do not select legal strategy on your behalf, evaluate the merits of your legal position, or guarantee any particular outcome, approval, or registration result. If you need legal advice, we encourage you to consult a licensed lawyer, whether from our referral network or otherwise.

7. Lawyer referral network

Where your matter requires legal advice or court representation, ClariCase may refer or connect you with an independent, licensed lawyer from our network of affordable partner lawyers in Davao City. Any lawyer we refer you to practices independently and is not an employee, agent, or partner of ClariCase. Any engagement, legal advice, representation, and fees for that representation are matters agreed solely between you and that lawyer, under a separate arrangement to which ClariCase is not a party. ClariCase does not supervise, direct, or guarantee the work, advice, or outcome provided by any referred lawyer, and referring you to a lawyer does not create an attorney-client relationship between you and ClariCase.

8. Limitation of liability

ClariCase is not liable for the outcome of your legal matter, registration application, or any engagement with a referred lawyer. To the fullest extent permitted by law, our total liability arising out of or relating to our services is limited to the amount you paid to ClariCase for the specific service in question. Nothing in these Terms is intended to limit any consumer protection right that cannot be waived under applicable Philippine law.

9. Communications and service delivery

Our services are delivered both in person and virtually — by email, phone, video call, secure document sharing, and in-person meetings in Davao City. We will let you know which option best fits your matter.

10. Governing law and venue

These Terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these Terms or our services shall be subject to the exclusive jurisdiction of the appropriate courts of Davao City, Philippines, without prejudice to any mandatory consumer protection right you may have under applicable law.

11. Changes to these terms

We may update these Terms from time to time. We will post the updated version on this page with a new "Last updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
